Terms & Conditions

These Terms and Conditions ("Terms") govern your access to and use of Content Machina ("the Service," "we," "our," or "us"), a marketing automation platform that integrates with Meta (Facebook/Instagram) advertising services. By accessing or using the Service, you agree to be bound by these Terms.


1. Acceptance of Terms

By accessing or using Content Machina, you confirm that you:

  • Are at least 18 years of age.
  • Have the legal authority to enter into these Terms.
  • If using the Service on behalf of a business, have the authority to bind that business to these Terms.
  • Agree to comply with all applicable laws and regulations, including Meta's Terms of Service and Advertising Policies.

2. Description of Service

Content Machina provides the following services:

  • Campaign Management: Create, manage, and monitor Meta (Facebook/Instagram) advertising campaigns.
  • AI-Powered Ad Creation: Generate ad copy and creative recommendations using artificial intelligence.
  • Performance Analytics: View and analyze campaign performance metrics retrieved from the Meta Marketing API.
  • Automated Optimization: Apply rule-based automation to optimize campaign budgets, bids, and ad status based on performance data.
  • Bulk Ad Management: Create and deploy multiple ad variations simultaneously.

3. Meta Account Connection

3.1 Authorization

To use the Service, you must connect your Meta (Facebook) account by authorizing Content Machina through Meta's OAuth process. By doing so, you grant us permission to:

  • Access your Meta ad accounts and campaign data.
  • Read performance metrics and analytics for your campaigns.
  • Create, modify, and manage ad campaigns on your behalf.
  • Retrieve ad creative previews and audience targeting information.

3.2 Your Responsibilities

You are responsible for:

  • Ensuring your Meta advertising account is in good standing.
  • Complying with all Meta Advertising Policies for any ads created or managed through the Service.
  • Maintaining the security of your Meta account credentials.
  • All advertising spend incurred through campaigns created or managed via the Service.

3.3 Disconnection

You may disconnect your Meta account at any time through the Settings page in the application or through your Facebook Business Integrations settings. Disconnecting will stop all data access but will not affect campaigns already running on Meta.


4. AI-Generated Content

4.1 Nature of AI Content

Content Machina uses artificial intelligence (including Anthropic's Claude) to generate ad copy, creative suggestions, and performance analysis. You acknowledge that:

  • AI-generated content is provided as suggestions and recommendations.
  • You are responsible for reviewing and approving all content before it is published or deployed.
  • AI-generated content may not always be accurate, appropriate, or compliant with advertising regulations.

4.2 Content Responsibility

You retain full responsibility for all advertising content published through your Meta accounts, whether created manually or with AI assistance. You must ensure all published content complies with applicable laws, regulations, and Meta's Advertising Policies.


5. Automated Optimization Rules

The Service offers automated rules that can adjust campaign budgets, pause or enable ads, and modify bid strategies based on performance metrics. By enabling automated rules:

  • You authorize the Service to make changes to your Meta campaigns on your behalf.
  • You understand that automated actions may affect your advertising spend.
  • You are responsible for configuring rules appropriately and monitoring their effects.
  • We are not liable for financial impact resulting from automated rule execution.

6. Acceptable Use

You agree not to use the Service to:

  • Create or distribute advertising content that violates any law or regulation.
  • Promote illegal products, services, or activities.
  • Create misleading, deceptive, or fraudulent advertising.
  • Infringe on the intellectual property rights of any third party.
  • Interfere with or disrupt the Service or its infrastructure.
  • Attempt to access data belonging to other users.
  • Use the Service in any way that violates Meta's Terms of Service or Advertising Policies.

7. Intellectual Property

7.1 Service Ownership

Content Machina and its original content, features, and functionality are owned by us and are protected by applicable intellectual property laws. The Service's code, design, logos, and documentation remain our property.

7.2 Your Content

You retain ownership of all content you create or upload to the Service, including ad copy, creative briefs, and campaign configurations. You grant us a limited license to use this content solely for the purpose of providing the Service to you.

7.3 AI-Generated Content

Ad copy, analysis, and recommendations generated by the AI features of the Service are provided for your use. You may use AI-generated content in your advertising campaigns without restriction.


8. Disclaimers

8.1 Service Provided "As Is"

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8.2 No Guarantee of Results

We do not guarantee any specific advertising results, including but not limited to impressions, clicks, conversions, or return on ad spend. Campaign performance depends on many factors outside our control, including your targeting, budget, creative quality, and market conditions.

8.3 Third-Party Services

The Service relies on third-party APIs and services (Meta, Anthropic, etc.). We are not responsible for the availability, accuracy, or reliability of these third-party services. Changes to third-party APIs may affect Service functionality.


9. Limitation of Liability

To the maximum extent permitted by law, Content Machina and its operators shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages.
  • Loss of profits, revenue, data, or business opportunities.
  • Advertising spend incurred through campaigns managed by the Service.
  • Losses resulting from automated optimization rules.
  • Actions taken by Meta on your advertising accounts.
  • Inaccuracies in AI-generated content or recommendations.

10. Indemnification

You agree to indemnify and hold harmless Content Machina and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

  • Your use of the Service.
  • Your advertising content or campaigns.
  • Your violation of these Terms.
  • Your violation of any law, regulation, or third-party rights.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination:

  • Your right to use the Service will immediately cease.
  • Running campaigns on Meta will not be automatically paused (you must manage these directly in Meta Ads Manager).
  • You may request deletion of your stored data as described in our Privacy Policy.

12. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Effective Date" at the top of this page. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.


13. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from these Terms or the use of the Service shall be resolved through good-faith negotiation or, if necessary, binding arbitration.
